Child Burned at Day Care in St. Paul, MN Should be Compensated
Our burn attorneys are representing several children burned at daycare centers and home day cares. Most of our cases were accidents where the daycare provider did not adequately supervise the child who was burned. This may have been the case yesterday when a a 16-month-old girl was severely burned at a home day care in St. Paul, New Generation Day Care. The owner of the daycare, Rosalind Loggin, told the St. Paul Pioneer Press that the burn victim and another child “climbed over a safety gate and went upstairs to the bathroom, where the other child turned on the bath water and the burn victim got inside.”
If what the day care provider said is true, it had to take quite a bit of time for two toddlers to climb over the safety gate, toddle up the stairs, turn on the bathtub faucet, and for one of them to climb into the tub. Where was the day care provider during this time?

Fire Hazard Prompts Recall of Husqvarna Riding Lawn Mowers
About 2,000 Husqvarna Riding Lawn Tractors are being recalled due to a potential fire and burn injury risk to consumers, the Consumer Products Safety Commission (CPSC) announced.
The manufacturer, Charlotte, North Carolina-based Husqvarna Professional Products Inc., is recalling the riding lawnmowers after receiving 53 reports in which the lawn mowers’ fuel line has been damaged. This could allow fuel leakage, which poses a serious fire hazard.
The fuel line on the Husqvarna Riding Lawn Tractors are too long, and could potentially come into contact with moving parts while the tractor is in operation. This is the defect that can cause the fuel line damage and subsequent fire hazard.

Burn Injury Hazard Results in Fireworks Recall
The risk of a burn injury has prompted a product recall by Lansing, Michigan-based Big Fireworks’ Super Lightning Rocket Fireworks, the Consumer Product Safety Commission, (CPSC) announced. The company is recalling 4,700 Super Lightning Rockets that are non-compliant with federal fireworks regulations. The recalled fireworks are one and a half inches in diameter and are mounted on a 32-inch stick. They were sold in packages of four with the item number GCR3150. On store shelves between Nov. 2009 and Jun. 2010, the were sold at fireworks stores in Florida, Indiana, Pennsylvania and Michigan. The fireworks labels are black with a solar system pattern in the background and say “Super Rocket” in various colors. According to the CPSC:
“The rockets are overloaded with pyrotechnic composition, violating the federal regulatory standard for this product. This could result in a greater than expected explosion, posing a risk of burns and bodily harm to nearby consumers.”
Consumers should not use the fireworks and may contact Big Fireworks for refund information. In a fireworks safety announcement, the CPSC says there are about 200 fireworks-related injuries each day in the United States during the month surrounding the July 4 holiday. In 2009 there were two fireworks related deaths and nearly 9,000 fireworks-related emergency room visits, according to a study by the Commission. Many of these injuries involve consumers younger than 20 and result in the loss of a limb.
If a defective fireworks product contributes to a fireworks burn injury, the victim may have a claim against the manufacturer of the defective fireworks.
Smoke Alarm Failure Causes Severe Burn Injuries
In a lawsuit filed in Illinois,1 a husband and wife claim to have been seriously injured after a smoke detector in their apartment failed to work. The complaint alleges that the husband suffered severe burns, smoke inhalation, kidney failure, emotional distress, amputation and other permanent disability. The complaint alleges that the wife suffered cuts, smoke inhalation and emotional distress.
This lawsuit is similar to an apartment fire lawsuit settled by Attorney Fred Pritzker. In that case, the smoke detector in the apartment did not work, and the landlord had not fixed it. A couch in the apartment caught fire and quickly burned, spreading the fire and filling the apartment with smoke. The mother and one son died. A daughter suffered severe brain damage (cerebral anoxia due to oxygen deprivation). Fred made claims on behalf of the family against the landlord and the furniture manufacturer. The resulting multimillion-dollar settlement was confidential.
Pritzker Olsen law firm has a national reputation in the area of product liability litigation. Lawyers at the firm have been interviewed and quoted by The New York Times, The Wall Street Journal, USA Today, Lawyers USA and others.
